1. Acceptance of Terms

By accessing or using Kupkaike ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Kupkaike is an AI-powered digital product bakery that helps creators generate digital product content, perform niche research, and create Pinterest marketing assets. The Service uses a cupcake-based credit system.

3. Accounts

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your account and for all activities that occur under it. Notify us immediately of any unauthorised use.

4. Cupcakes & Payments

• New accounts receive 20 free cupcakes upon sign-up.
• Purchased cupcakes never expire and are non-transferable.
• Refunds on unused cupcakes are available within 7 days of purchase. Consumed cupcakes are non-refundable.
• Prices are displayed in USD and are subject to change with reasonable notice.
• All payments are processed securely by Stripe.

5. Acceptable Use

You agree not to:

• Use the Service to generate illegal, harmful, or infringing content.
• Attempt to circumvent rate limits, cupcake deductions, or access controls.
• Reverse-engineer, scrape, or abuse the Service's API.
• Share your account credentials with others.
• Use the Service to generate content that violates the terms of third-party platforms (e.g. Gumroad, Etsy).

6. Content Ownership

You retain ownership of the content you generate using the Service. By using the Service, you grant Kupkaike a limited licence to process your inputs to deliver the outputs. We do not claim ownership of your generated content.

AI-generated content may not always be accurate, original, or suitable for your specific purpose. You are solely responsible for reviewing, editing, and using any content generated by the Service.

7. Intellectual Property

Kupkaike, its logo, and all associated software are the property of Kupkaike. You may not copy, modify, or distribute the Service or its components without prior written consent.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that generated content will meet your requirements or generate income.

9. Limitation of Liability

To the maximum extent permitted by law, Kupkaike shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of profits or data.

10. Termination

We reserve the right to suspend or terminate accounts that violate these Terms. You may close your account at any time. Upon termination, unused cupcake balances are non-refundable unless within the 7-day refund window.

11. Changes to Terms

We may update these Terms at any time. Material changes will be communicated by updating the date above. Continued use of the Service constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by applicable law. Any disputes will be resolved through binding arbitration or the applicable courts.
